Filing a Complaint

ORM aims to prevent and address unlawful employment discrimination while promoting equal opportunity for Department of Veterans Affairs (VA) employees and stakeholders.

If you feel you have been subjected to discrimination, you have the right to file an Equal Employment Opportunity (EEO) complaint with ORM. To get started, select one of the above options to create an account to begin your complaint submission or sign in to begin your complaint submission.

EEO Complaint Processing


ORM provides EEO complaint processing services within VA. This includes confidential counseling, mediation, and investigation.

If you are an employee, former employee, or applicant for VA employment and believe that you have been subjected to discrimination, you have the right to file a complaint. The alleged discrimination must be based on race, color, sex, religion, national origin, age (over 40), physical or mental disability, genetic information, or reprisal for EEO activity.

An informal complaint must be filed within 45 calendar days of the alleged discriminatory act, event, or the effective date of an alleged discriminatory personnel action. An informal complaint must be filed before a formal complaint can be made.

Civil Rights Discrimination Complaints


ORM is VA’s liaison with the Department of Justice for addressing issues of discrimination in federal programs and activities. ORM receives and refers for investigation, complaints from individuals who believe they have been discriminated against based on their race, color, national origin (limited English proficiency), age, sex, disability, or reprisal in federally conducted and federally assisted programs or activities. Federally conducted programs are those that are directly administered by the Department, such as healthcare and other VA benefits. Federally assisted programs are those programs that receive Federal financial assistance.

ORM serves as the intake office for Civil Rights Discrimination Complaints. When a complaint is received, ORM reviews and forwards it to the appropriate Administration or Staff Office for investigation.

Civil Rights Discrimination Complaints do not apply to current or former federal employees (including those employees who have Veterans status) or prospective federal employment applicants.

What Falls Outside ORM’s Scope?

  • Allegations involving crimes (see 38 C.F.R. § 1.204) (opens in new window)
  • Allegations within the scope of Office of Accountability and Whistleblower Protection(opens in new window), such as Senior Leader Misconduct or Poor Performance and Whistleblower Retaliation by any VA Supervisory Employee
  • Veteran requests for care or benefits 
  • Allegations under litigation or covered by another remedial administrative process such as the Merit Systems Protections Board, Office of Special Counsel, Federal Labor Relations Authority, EEO Commission, or the negotiated grievance procedure
  • Allegations appropriate for review by the VA Office of Inspector General (opens in new window)or the VHA Office of the Medical Inspector (opens in new window)
